In 2009, the Washington-area Metro train system witnessed its largest crash in the history of the city. 9 people were killed and dozens of others were injured when their Metro train slammed into the back of a stopped rail car.

The cause of the accident is being blamed on faulty equipment manufactured by the transit agency responsible for the Metro-area systems. Currently, the transit company is in the process of settling lawsuits with all of the families of those who were killed in the accident. 7 of 9 lawsuits have already been settled.

Cases like this are far too common; cases of negligence, faulty engineering, etc. that result in the death and injuries of hundreds to thousands of people every year. At Wagner Reese, we work hard to bring justice back to these cases. Negligence should never be rewarded and we want to make sure the people who have suffered don’t have to continue suffering.

Last Thursday, a semi truck on I65 that was carrying large steel coils was cut off in traffic and had to swerve to avoid hitting another vehicle. Because of the extreme braking and swerving the semi was forced to do, one of the steel coils on its load broke loose and fell into the right lane of traffic.

As the steel coil unrolled, it rolled down the exit lane for US30 and hit two stopped vehicles (a 1996 Ford Ranger, and a 2012 Hyundai Accent). Other vehicles drove over the steel coil, causing damage to their vehicle, and still others swerved to avoid the unraveling coil and hit other vehicles in the process.

Dale Gipson – the semi truck driver – was cited for driving while suspended and for having a load that was unsecured. Thankfully, no major injuries were reported, but because of the driver’s recklessness, many severe injuries or deaths could have been caused. An Indianapolis mother & a tow truck driver were both arrested last Thursday night after the tow truck driver towed away the woman’s vehicle while her son was asleep in the back seat.

The woman, Robyn Hardy, told police officers she left her son in the back seat to sleep while she went into the Dollar General store for about 15 minutes. The tow truck driver, Jason Gossett towed her car because she had left it parked in the fire lane. Admittedly, he did not look inside the car before he towed it away. When Hardy came out of the store and realized her car and her son were both gone, she immediately called the police. The Gossett brought the vehicle back as soon as she realized the boy was inside, but when the police examined his rigging, they realized the car was not attached properly, lacking safety lights and straps.

Police charged Gossett with reckless driving, and they also charged Hardy with negligence of a dependent because she had left him in the vehicle when it was only 30 degrees outside. Both were arrested.

Unfortunately, the story of Gossett is far too common. Reckless drivers are all around us and can cause incidents far worse than this one. Fortunately Hardy’s son was not injured, but can you imagine the devastation if he had been?

At Wagner Reese, we work hard to bring justice to situations like these. No, Hardy should not have left her son in that vehicle in such inclement weather, but that does not mean it was an excuse for Gossett to be so reckless in his job. To read the full story, click here.

If you or a loved one have been injured by the recklessness of another person, don’t hesitate to call us! We can help you get the settlement you deserve for the physical and emotional trauma you have experienced. A recent study performed by Consumer Reports found that pediatric intensive care units in the United States have at least a 20% higher infection rate than adult intensive care units.

Consumer Reports studied 98 pediatric intensive care units in 31 different states across the country (they studied only hospitals that reported their infection data). Out of all of these 98 pediatric ICU’s, the infection rates were at least 20% higher than the national rates for adult ICU’s.

Part of this problem is attributed to the fact that children don’t have as high of an input on the cleanliness and sterilization of their central lines and catheters. Parents are encouraged to assist the medical staff in keeping an eye on the cleanliness of their children’s equipment. With consistently full pediatric units, medical staff can often overlook things that increase the likelihood of an infection.

At Wagner Reese, we encourage you to do extensive research on the medical facilities available to you. Our first suggestion is that if a hospital does not report its infection data, avoid it. If hospitals are not willing to share their infection rates and other data with the general public, typically that means their rates are higher than others and you should find another health care provider.

If you or a loved one have been the victim of a medical malpractice that resulted in a potentially deadly infection, call the expert medical malpractice attorneys of Wagner Reese today. We will fight against the hospitals for you and get you the money you deserve to compensate for your injuries and sufferings. Don’t wait any longer. Show them you’re serious!
